Colorado Internet Sales Tax - HB-1193

Posted on January 27, 2010 3:28 PM by Joel Comm

The Colorado state legislature is considering placing a tax on all online ecommerce conducted for state residents.

HB-1193, if passed, will have a dramatic affect on affiliate sales of goods and services for those affiliates and merchants conducting business in Colorado.

We received a letter from Overstock.com, one of our affiliate partners.

You can read this letter along with other relevant information related to this issue on the blog at Colorado Internet Tax

Once again, government has absolutely no clue about what to do to encourage business growth. Instead of getting out of the way and allowing businesses to do what they do best, they interfere and cause even greater problems.

My friend, Rob McNealy, is running for a seat on Colorado's 6th Congressional District. He is fed up with an over-reaching government and is pledging to fight for our rights.

I encourage you to check out his site at Rob McNealy for Congress.

Wow!

This will greatly impact Colorado affiliate as well as Overstock as a company. I agree, the government should stay out of the way of businesses - this will surely hinder growth.

God Bless you for having the Guts to speak out and supply links to educate people about what is happening to us. The sad part is that our children do not have a clue. They don't watch the news and are so busy with their lives, as we were at their age, they do not know or understand what is going on.

We should come up with a plan to reach our youth. A real, organized plan!

My son is in the Navy, is educated, and has been in for 10 years. His attitude is shifting to the left because of the attitudes of his less educated team mates. His attitude is also being shaped by government propaganda.

I just want to shake him by the shoulders and say wake up and look around. Smell the roses! Think! Question!

We need to reach out to these kids. They are giving their "all" and our government is miss-representing, and Minipulating our children.

This not the right step, already FTC guidelines made it hard for affiliate to make money.

Govenor Ritter has no clue what he is doing. He has no financial understanding of the importance of small businesses and their impact the economy. It's very sad that things have gotten so far.

A year ago, in order to more easily move to San Diego from Canada, I made the decision to sell or otherwise get rid of most everything I had and reduce it all down to what could fit inside two suitcases. A radical step to be sure but one I have not regretted one bit.

I sold my Suburban truck, gave away or sold all my posesions, and made the move with God's help (an incredible story in and of itself).

But one nice thing about living simply like I still am is that I can flexibly move elsewhere if the need arises to do so. I am not weighed down by the usual smattering of worldly possessions that most people have. Not that I am against such per se. Rather it's that I don't need or want so much stuff in my life at this point.

I believe things in the U.S. are going to get worse. Much worse. Not before they get better. Just worse.

One of the reasons I am entirely focused on making a living over the internet is that I want the flexibility to go and live in South America.

I feel for those of you that are "stuck" where you are. That see the direction the U.S. is going and can't do a whole lot about it.

But...for those of you that can it might be worthwhile to make backup plans to move elsewhere. At the very least to another, less regulatory state to live in. If things get really bad.

It always pays to be prepared. Internet marketing is certainly a vehicle to allow us to do just that. Live anywhere with an internet connection.

I like that.

It's only a matter of time before other states follow NY.

I don't begrudge tax, to a certain extent. However it is going to make life more complicated at least to begin with.

Amazon seems to be taking a close look at this and I'll be keeping my eye on them as more states try to impose these internet taxes.

Cheers,
Shane

Carlos, part of what you said goes against the remainder of this discussion. The part about being American - we don't run from problems, we stay and fight.

Connie and Chris, I'm not certain what your comments have to do with this particular Bill since the entities you speak about have not been involved to this point.

Shane, thank you for mentioning Amazon as well. I'm certain they and a number of other very large online retailers are watching. But don't forget smaller retailers who may also be affected if the out of state retailer earnes more than $10,000 from sales through Colorado Affiliates. This is where this legislation will have a negative effect - when it hits the smaller business who rely on affiliate sales not for keeping the lights on but rather for having a shot at getting ahead financially.

It is a real shame how the government feels that it has to have its hands in everything. I am growing very, very tired of being micromanaged. I hope that states do not follow NY's lead on internet taxation. Unfortunately, that is probably wishful thinking on my part.

Affiliate Marketing is a performance based sales technique used by companies to expand their reach into the internet at low costs. This commission based program allows affiliate marketers to place ads on their websites or other advertising efforts such as email distribution in exchange for payment of a small commission when a sale results.

The Colorado HB 1193 has already affected me... Over the past few days, I've received emails from three of the affiliate programs that I've involved with stating that they are dropping me as an affiliate because of this stupid bill the the Colorado legislature is about to pass... One wouldn't think that in America, states would try to block free enterprise and the freedom of their citizens... I'm not the best affiliate marketer, but the commissions that I earn allow me to afford giving birthday and Christmas presents to my kids and grandkids... I was hoping that by the time I retire, I would have this business off the ground and it would afford me the comforts that we want in retirement... Now I'm going to have to move to another state to do that... Way to go Colorado...

Just when the little guy found a way to save a few dollars on personal goods purchased, that is, over the internet, the greedy politicians find a way to hurt the little guy some more. I wonder how much was sold over the internet to Colorado residents last year, and, I wonder just how much more money will now flow from the pockets of the consumers, this is money they were taxed on already, into the coffers of the degenerate politicians?
Remember, this is money that was taxed by the State through the State Income Tax System and now the politicians want more...What a disgrace!
